Pirated Software?
I bought a copy of Windows 7 from Ebay. I received an ORIGINAL disk, but from Dell computer company...the disk is still in my possession. Now the computer is telling me that I have an unregistered copy of the software and offering me a chance to buy (AGAIN) a validated registration number! I am now 59 years old, too young to retire and too old to get a good job. I make 400 a month, give or take, which is the reason I was shopping on EBay in the first place. There is no way I can take the seller to court and get my 80 back, and paying a company that clears billions a month more than a quarter of my paycheck for software I HAVE PURCHASED seems a bit much. Let me also add, when I was working full time I bought, full price, the following operating systems from Microsoft: Windows 3.11, Windows 95, Windows 98 Upgrade, Windows NT, Windows 2000, Windows XP AND I have two copies of Windows Vista (English and German) bought from Ebay. (Check your records MS) Would Microsoft consider taking one of my body organs in exchange for keeping my computer running????????

1. In my humble opinion eBay is responsible for genuine origin of goods displayed. (This is an implication from the case of YouTube.) 2. I would address eBay first. If you are not successfull in this first step, address Microsoft representative and/or Microsoft Activation center. It depends on you how far you want go. You can expect the answer that you should buy from Microsoft Partners. You should have valid invoice, COE label and media. 3. I do not fully understand following: I received an ORIGINAL disk, but from Dell computer company...the disk is still in my possession If it is OEM (namely the installation medium for notebook or desktop), then is is violation of law, because of this should be paired with hardware. OEM is not transferrable software version withou hardware. You should buy OEM software with hardware (Invoice + COE + media rule applies here too) 4. Taking body organs has been solved in favour of possible "donor" since Shakespeare times and the same is true for any drop of your blood. In summary: You have done a risky business and the loss is more probable in this purchase. Place the question here or address local Microsoft representative before you decide to buy Microsoft software from third party. Study more carefully the rules of channel from which you buy. This installation of Windows is using an OEM_SLP Key - which is ONLY valid for installs on a machine built by a specific manufacturer, with a specific BIOS (in your case the OEM is Dell) Your motherboard is a retail ECS board - and cannot support an OEM_SLP Key. Not buying body parts, rather like contracting to marry from a prior husband, setting up with the girl, then have her father come and demand another couple camels..........(since Omar the tentmaker times the father gets a couple camels). Of course if the body parts theory is true, a more valid comparison would be that each and every piece of that old computer, Dell is owed another bribe. Great, if you can get away with it, selling, then reselling, then reselling the same thing...............

Great, if you can get away with it, selling, then reselling, then reselling the same thing............... There are at least two kinds of OEM licenses that I know of. Either is cheaper than a retail license, but they come with restrictions. One is the generic system builder license, which can be installed on any PC. That is supposed to be bound to the PC (defined by its motherboard) that it's first installed to. Microsoft may refuse to activate it if it's installed on a different motherboard. Another type is SLP. That's the one you have. It may only be installed on a motherboard whose BIOS contains a string that matches the license. Can you get any redress on your purchase through PayPal, if you used that service? I got a refund once that way, but the purchase was from an online shop (rather than a private seller). They refunded my purchase rather than having a complaint show up on their PayPay listing. (Incidentally, the product was Adobe Photoshop CS4. Turned out to be a pirated copy.) Microsoft has a "Get Genuine" program, but I believe that the price they charge for a license is about the same as what you'd pay for a System Builder copy. (It appears that's what they sell you.) If you have all of those Windows licenses, perhaps you could use one of them for the moment. (Win7 isn't vastly different from Vista, and the Vista driver issues have mostly been sorted since 2007.) Ubuntu?

Well, the little girl that sold it to me was just as astonished as I was that MS tries to press every penny out of people that they can. I would think a fair way of doing this would be for me to pay the difference in what Dell paid and the full price.....but MS can't stand to see an opportunity to fleece someone get by. The young lady that sold it does NOT sell pirated items...besides, with the original PC in pieces, the money MS received for that copy is a gift as the OS licence is not being used. Of course this is the curse of people with too much money, it calls to it's own and they lie awake nights worrying that someone will get away with a dime that they would never miss anyway. Unfortunately, this is EXACTLY why they never caught Jessie James (he had to be murdered) and they had so much trouble getting Dillinger, having to coerce someone to turn him in by threatening to deport her (they did anyway after he was betrayed).........because both of them limited their theft to people who spent the time off from their steak and lobster lunches, taking things from the less fortunate. I do know that from now on, having experienced "the fat man's greed", will never turn in a pirate again, I will also applaud any politician that goes after the big monopoly that is Microsoft, and I will tell any that will listen the full story behind what happened to me. Having spent the last day and a half, ripping the Win7 off and replacing it with one of my Window's Vista that I paid full price for, I am in the process of replacing all my software. In other words MS might have gained what they got from Dell for free, but lost the difference that I would have paid, and made a future potential customer very angry. Good Job MS!

MS are suing a large company in the UK for producing copies of Recovery Disks such as you received. You have NO License for the installation - the disk is NOT the license. OEM Licenses come with a Certificate of Authority - which is attached to the PC, and cannot be moved. The License terms state specifically, that the license cannot be moved from the PC on which it is first installed. If you had bothered to read the license terms when you installed the OS, you would have realised that your installation was not legal. Everyone seems to want to jump on the poor little college kid that I got this from. Neither she, nor I, wished to pirate anything. The license is NOT being used, and was paid for, so she (and I, after I bought it) thought everything was OK. Neither of us committed a crime as that entails INTENT.....neither of us intended to defraud anyone. I again state that a good way to resolve this is that MS is reimbursed the difference in the paid price and the full price of a normal copy. I have replaced the OS with one I KNOW is valid (Vista) and will frame the Win7 CD to hang it in a prominent place. Of course this will evoke curiosity which will allow me to tell the whole story.....and mayhap, who knows, it will reach the ears of one of Microsoft's MAJOR customers and change their mind about doing business with them. Stranger things have happened..............

Microsoft should give you a full retail copy of Windows 7 Professional, for your pains. They should deliver it on a more powerful PC. They should pay your Internet access charges for the remainder of your natural life. Microsoft has great piles of cash, which they should use to support needy individuals. (They aren't in the same league as Apple Computer any more, but they are still rich.) Does that make you feel better? I dislike some of Microsoft's licensing arrangements, not because of fairness, but because they are confusing. Ordinary people should be able to discover what they own, without excessive effort.

'This little girl' may not even be a little girl at all, but rather a scammer. Sounds like he/she took advantage of you by providing either false or misleading information or not giving full disclosure. It's not Microsoft's fault, it's not E-bay's fault, it's not your fault. E-bay has a zero tolerance for counterfeit and scammers. All you have to do is file a counterfeit complaint and they will refund your $ and ban the seller. You will be helping others. The sale and transfer of a Dell OEM Windows 7 Reinstallation disc is only valid if the the original Dell computer is included with the disc. Otherwise, the separate sale of the disc is considered a violation of the Windows 7 OEM license agreement. Please review: Transfer of OEM Licenses. You need to contact the eBay seller and demand a full refund. Then purchase a genuine "Full Retail" edition of Windows 7 from a trustworthy, reliable source such as the Microsoft Store. Carey Frisch
