When i run the WBADMIN start system state I receive no output and no system state output

The LOG files are empty, but there is one file that is created it is the Wbadmin.1.etl file

Thanks for the post but it did not work, I was able to Takeown for \PendingRenames and Takeown for \Filemaps, rand the net stop and start for cryptsvc still received this results:

Found this in the Event log
Backup started at '7/8/2011 4:53:46 PM' failed with following error code '2155348226' (System writer is not found in the backup.).

Found this entry in the Application Event log
The Cryptographic Services service failed to initialize the VSS backup "System Writer" object.
Details:
Could not open the EventSystem service for query.

Hi,
It seemed that you have an Event ID 512 error. You should modify the access control list on the registration folder.
To perform the following procedure, you must be a member of the local Administrators group, or you must have been delegated the appropriate authority.
To modify the access control list on the COM catalog folder:
1.Click Start, and then click Computer.
2.Navigate to %systemdrive%\Windows.
3.Right-click Registration, click Properties, and then click the Security tab.
4.Click Advanced, and then click Edit.
5.If the User Account Control dialog box appears, confirm that the action it displays is what you want, and then click Continue.
6.Click Edit to view the special permissions assigned to this folder.
7.Ensure that the access control list matches the following criteria:
The local Administrators group has Full Control permissions applied to This folder and files.
The Everyone group has List folder/read data, Read attributes, Read extended attributes, and Read permissions applied to This folder and files.
The local SYSTEM account has Full Control permissions applied to This folder and files.
8.If the permissions on this folder do not match what is listed in this procedure, make the appropriate changes, and then click OK.
9.In the command prompt window, type 'vssadmin list writers'. Ensure that Writer Name: 'System Writer' is displayed in the list.

I have checked the security settings for the C:\Windows|Registration folder. The Domain Admininistrator (this machine is a Domain Controller), and the System accounts have full congtrol of the folder.
When I run the vssadmin list writers the "System Writer" is not in the list of writers.

Have you re-install backup service? If not, try to re-install it and see how is everything going.

I have re-installed the backup servece, I have taken ownership and run the icacls commands, I have confirmed that the Registry has the REG_DWORD = 1 in the VSS\VSSAccessControl, there are no Event ID 513 (there are 512) or 8213 errors in the Event Log\Application.
When I run vssadmin list writers I NEVER get System Writer
The Volume Shadow Copy service is run using the Local System account
I am at a loss unless there is an update that I have not applied to the Server 2008 Domain Controller I am using
I just applied all the updates for this Dimain Controller and still no System Writer

The Cryptographic Service is using the Network Service account
I used MSCONFIG and disabled all non Microsoft services from starting but the System Writer was still not in the list of Writers
I have applied all the updates for this Dimain Controller and still no System Writer
I have checked another Server 2008 Domain Controller and it does NOT show the System Writer when listing the writers
Using the GUI (Windows Server Backup) I am able to do a Backup but it is larger then the SystemState that I want to backup
Why can I use the GUI but not the CLI to do the backup?
