in Exchange 2013 CU1 when i activate option of Database can be overwritten by a restore then i restart the information store or the server, this option will return inactivated.

anybody face the same problem? and is this error is a bug?

I'm sorry, I'm not very clear, do you mean active a database copy and it perform restore when you choose active ?

Would you insert a screenshot ?

in ECP > Servers > Databases > Select the database and click edit button > maintenance > this database can be overwritten by a restore  

I mean this option will be inactive after restart the server so i should reactive this option after every restart of server or information store restart

This is the expected behavior once the service is restarted and/or the database is mounted.
