there are many considerations when it comes to spam. Like A: how did your user end up with it in the first place, what antispam software are you using this will help identify ways of stoping it. You can view the message report and it should give you a spam confidence level. But the best advice i have is if your unsure mark it as junk as this alters the spam confidence level and eventually will stop it coming through to you.

General speaking, Emails you did not ask for that were sent in bulk from unknow senders are spam. 1. Newsletters you did sign up for, an email from a college friend and messages from people trying to contact you personally are, of course, not spam. 2. A newsletter somebody signed you up for to annoy you is not spam but a different kind of email abuse. 3. An email sent to you in bulk by an unknown sender that you do in fact welcome and find useful may not be spam either. Every email you asked for is not spam but not every email you did not ask for is spam. So may be the Spam tools regard the E-mail as spam, but you don’t think so. Please remember to click Mark as Answer on the post that helps you, and to click Unmark as Answer if a marked post does not actually answer your question. This can be beneficial to other community members reading the thread.
