I raised a case with MS PSS in the end, we have managed to fix this by uninstalling update roll up 5. so we are now running on update roll up 4 which works fine for us. They said they wanted to re-apply 5 and some dot net hot fix but i told them we didnt want to as the server is working for our client now.
