We upgraded from 2010 to 2013. The workflows that came over will not run and I cannot delete them. When I attempt to delete them I get "Server error: The file xxxx is checked out for editing by .". When I try to create and run a new workflow it fails with "canceled by System Account" and "failed to start".

According to your description, after upgrading from SharePoint 2010 to SharePoint 2013, the old workflows stop working and cant be deleted.

Can you try republishing these workflows in SharePoint Designer to see if they can work?

I suggest you check the ULS logs to see if it can provide more information about this issue.
